Marshall, Elery & Associates are not private investigators, or a private investigative agency, nor are we process servers, or bailiffs.

 

Client cases, which we determine may require private investigative services, are outsourced to seasoned licenced private investigative firms, with whom we have an established on-going professional working relationship.

CRIMINAL DISCLOSURE REVIEW

In 1991, the Supreme Court of Canada, in the case R. v. Stinchcombe unanimously ruled that the Crown has a duty to provide defence with all evidence, that could possibly be relevant to the case, regardless of whether the Crown plans to call that evidence at trial or not, or whether it helps, or hurts the Crown's case.

The Supreme Court of Canada, in their decision ruled that the duty to disclose is derived from the right of an accused to make full answer and defence, which is entrenched under Section 7 of the Canadian Charter of Rights.

​

"The Crown, has a legal duty to disclose all relevant information to the defence.  The fruits of the investigation, which are in its possession, are not the property of the Crown for use in securing a conviction, but the property of the public, to be used to ensure that justice is done."

​

Disclosure is one of the most important elements in the preparation of a criminal defence. Too often, defence counsel is either overwhelmed with the numerous volumes of evidence, or extremely busy to review, and examine the provided disclosure. 

​

It is not enough for defence counsel to simply read the Crown Brief and disclosure material on the evening before trial.  Proper preparation for trial, always requires a meticulous and detailed review, analysis, and examination, of the disclosure provided by the Crown.  In fact, defence counsel will never know, if there are any deficiencies or notable omissions in the provided Crown disclosure, if they do not conduct a thorough review immediately upon receipt.

It is especially important to thoroughly examine the notes, and reports of police officers, as many are very difficult to read.

​

Marshall, Elery & Associates provides experienced and well honed consultants, examiners, researchers, and analysts which will thoroughly and meticulously examine, and probe Crown Briefs, disclosure material including statements, video evidence, photographs, forensic evidence, reports and certificates, financial documents, police notes, search warrants and information to obtain, reports of experts, and other evidence.

Marshall, Elery & Associates, upon completion of their examination of a Crown Brief, and disclosure material, will provide defence counsel a comprehensive analysis report of their findings, including:

​

  • detailed notes and observations for use by defence counsel at trial;

  • details requiring elucidation;

  • details requiring additional disclosure requests;

  • details requiring legible or typed copies of notes;

  • detailed list of discrepancies in the evidence;

  • detailed statement analysis report;

  • detailed list of investigative concerns;

  • missing evidence;

  • continuity concerns; and

  • additional information which would be of assistance to defence.

 

In order to provide an effective and successful defence at trial, it is extremely important that a detailed review of the disclosure material be conducted well advance of the trial date.

CIVIL LITIGATION DOCUMENTATION REVIEW

Marshall, Elery & Associates are cognizant of the fact, that litigation lawyers are often extremely busy, have time constraints, and no matter how well organized, skilled, experienced, or efficient, they cannot possibly review all the work, files, documents and disclosure material, that crosses their desk.
