CRIMINAL DISCLOSURE REVIEW
In 1991, the Supreme Court of Canada, in the landmark decision of R. v. Stinchcombe, unanimously ruled that the Crown has a legal duty to disclose to the defence all evidence that may be relevant to the case, irrespective of whether the Crown intends to introduce that evidence at trial or whether the evidence is favourable or prejudicial to the Crown’s position.

The Supreme Court of Canada established that this duty of disclosure is derived from the accused’s constitutional right to make full answer and defence, as enshrined under Section 7 of the Canadian Charter of Rights and Freedoms.
​
The Court stated:
​
“The Crown has a legal duty to disclose all relevant information to the defence. The fruits of the investigation, which are in its possession, are not the property of the Crown for use in securing a conviction, but the property of the public, to be used to ensure that justice is done.”
​
Disclosure is a foundational element in the preparation of a robust criminal defence. However, defence counsel are often burdened by voluminous disclosure materials or constrained by time limitations, which may impede a thorough review and analysis of the Crown’s evidence.

It is insufficient for defence counsel to review the Crown Brief and disclosure materials on the eve of trial. Effective trial preparation necessitates a meticulous, systematic, and detailed examination of the disclosure as soon as it is received. Without a comprehensive review, deficiencies, inconsistencies, and critical omissions in the Crown’s disclosure may go unnoticed, potentially jeopardizing the defence strategy.

Particular attention must be given to police officer notes and reports, which are often handwritten and may be challenging to interpret.
